1.2 These General Conditions of Use of the Site (hereinafter, “ Conditions of Use”), together with the general conditions of sale (hereinafter, “ GTC”), the privacy policy and the cookie policy published on the Site, regulate the access and use of the Site and the related services by each user, without any distinction (hereinafter, “ Customer”). 

1.3 Access to and use of the Site presupposes knowledge, acceptance and compliance with these Conditions of Use of the site as well as the GTC, the privacy policy and the cookie policy.

By visiting and using our Site and/or purchasing a product supplied by Anirav Brand, you expressly agree to be bound by these Terms of Use, the GTC, the privacy policy and the cookie policy.

1.4 Anirav Brand reserves the right to modify and/or update all or part of the Terms of Use and/or the General Terms and Conditions and/or the Privacy Policy and/or the Cookie Policy at any time by posting new terms and conditions. The Customer's use of the Site constitutes acceptance of all the Terms of Use and/or the General Terms and Conditions and/or the Privacy Policy and/or the Cookie Policy on the Site as amended and updated. If the Customer does not agree with any of the terms or the Terms of Use and/or the General Terms and Conditions and/or the Privacy Policy and/or the Cookie Policy on the Site, he or she must immediately discontinue use of the Site.

2. CUSTOMER – DEFINITION AND REGULATION

2.1 The use of any service on the Site gives the user the status of Customer.

2.2 To use the sales services offered by the Site, it is not necessary to register. 

If applicable, registration will be carried out in the manner expressly indicated on the Site and the Customer, in this case, will acquire the status of registered Customer (hereinafter, “ Registered Customer”).

2.3 In any case, by using the Site and the related services, the Customer declares:

• have a valid email address;

• to be in possession of a valid payment method in case of using the sales services offered by the Site.

2.3 The Customer declares, under his/her sole responsibility, that all information provided during registration is complete, correct, and truthful. Anirav Brand declines all responsibility for any consequences arising from the provision of false, incorrect, inaccurate, or incomplete information during registration.

3. GENERAL CONDITIONS OF SALE

3.1 Contracts for the sale of goods concluded through the Site with Customers will be governed by the GTC which guarantee, where applicable in the case of a Consumer Customer, the rights set forth in Legislative Decree 206 of 2005 ( the “ Consumer Code”) and related updates. 

The Customer is invited to consult the GTC in the appropriate section on the website. 

3.2 Contracts for the sale of goods concluded through the Site will be archived in the Anirav Brand database for the time necessary for their execution and, in any case, within the terms of the law.

4. LIMITATIONS ON USE OF THE SITE

4.1 By accessing and using the Site, the Customer undertakes and undertakes not to:

• use automatic devices, software or other systems aimed at damaging the Site, cataloging the Site or any information contained therein as well as using automatic devices, software or other systems aimed at interfering or trying to interfere with the functionality and services of the Site;

4.2 Anirav Brand reserves the right, at its sole discretion, to block the Customer's access to and/ or use of the Site in the event of violation of one or more provisions of the General Conditions of Use of the Site, the applicable GTC and any instructions published from time to time on the Site.

5. PRICES AND TARIFFS

5.1 The prices indicated include VAT.

5.2 In the event that shipping is not free for a specific purchase, the relevant amount will be indicated separately before the Customer proceeds to confirm the purchase .

5.3 In the case of purchases for export to non-EU countries, the indicated price will be understood to exclude VAT (which the user will have to pay using the methods and at the rate specific to the country of destination), charges, customs duties and shipping costs. 

6. INTELLECTUAL PROPERTY

6.1 The content published or accessible through the Site is protected by applicable copyright and industrial property laws. Anirav Brand is the owner and has the right to use the Site, its pages, and the information or elements contained in the texts, documents, photographs, drawings, graphics, software, codes, logos, trademarks, trade names, or other distinctive signs protected by intellectual or industrial property rights.

6.2 It is prohibited to reproduce, modify, decode, distribute, copy and disclose the information or elements mentioned above.

7. DISCLAIMERS

7.1 Anirav Brand publishes information on its Site to provide a service but declines all responsibility for any technical inaccuracies and/or typographical errors. Once any errors are brought to its attention, Anirav Brand will correct them. Anirav Brand also reserves the right to make corrections and changes to the site, if necessary, without prior notice. 

7.2 Anirav Brand offers no guarantee that the information published on its Site complies with the laws of the jurisdiction competent for the Customer.

7.3 Anirav Brand declines all responsibility for any problems, damages, viruses or risks that the Customer may incur while using the Site and declines all responsibility for any malfunctions of the same, even those caused by the deactivation of " cookies" in the browser. 

7.4 Anirav Brand assumes no responsibility for the incorrect use made by third parties of the Customers' access credentials, who remain solely responsible towards Anirav Brand and towards third parties for the correct use of said credentials.

7.5 Anirav Brand does not guarantee continuous and uninterrupted access to the Site and its services, which may be affected by factors, including technical ones, beyond its control. 

7.6 Anirav Brand assumes no responsibility for the management of payment services and any refunds which are delegated to third parties.

7.7 In all of the above cases (within the limits set by the Consumer Code, if applicable, and other applicable laws), Anirav Brand excludes any guarantee and cannot be held liable in any way for any economic loss, loss of goodwill, damage to commercial reputation, direct, indirect or consequential damages arising from the use of the Site and the services offered therein. 

7.8 In any case, any compensation for Anirav Brand's liability towards the Customer or towards third parties is limited to the amount of Euro 500.00.

8. APPLICABLE LAW AND JURISDICTION

8.1 Access to and use of the Site by the User are subject to Italian law. 

8.2 In the event of a dispute relating to or arising from the Customer's access and/or use of the Site, the Court of Milan shall have exclusive jurisdiction, without prejudice to the rights provided for by Legislative Decree 206 of 2005 ( the " Consumer Code"), in whose case of applicability, disputes relating to or arising from the Customer's access and/or use of the Site shall be referred to the consumer's Court in accordance with the provisions of the Consumer Code.
